Welcome to Colors of Life by Declan. These terms cover your use of our website and the custom coloring books and related products you order from us. By placing an order you agree to them.
Every book is a custom, made-to-order product created from the photos and words you provide. Because each one is personalized and printed for you, it cannot be resold, so a few of the terms below (especially around approval and returns) work a little differently than for off-the-shelf goods.
We love showing off what our customers create, but we only do it with your say-so. When you upload photos there is a separate, unticked box: "Colors of Life may show the coloring pages and finished book it makes for me as examples of its work." If you leave it unticked, your book stays private and nothing from it is used in our marketing. Nothing else in these Terms grants us any promotional right.
If you tick that box, you grant Colors of Life by Declan a non-exclusive, royalty-free license to show the artwork we generate from your photos (coloring pages and cover illustrations) and images of your finished book on our website, product pages and social media (currently our Pinterest, Instagram and Facebook accounts, all under the name colorsoflifebydeclan), and in our own advertising and press materials. This license never includes your original photographs, and we will not use your name. It does not extend to selling or transferring the artwork to anyone else, and you may withdraw it at any time by emailing hello@colorsoflifebydeclan.com; we will stop new uses right away and remove existing posts within 30 days where we control them.
If the artwork shows a child, please tick the box only if you are that child's parent or legal guardian, or have their parent's or guardian's permission. We may ask you to confirm this before featuring a book. You keep ownership of your original photos in every case.
Please do not upload unlawful, hateful, harassing, sexually explicit, or otherwise harmful content, any content that exploits or endangers a minor, or any image you do not have permission to use.
We screen uploaded images automatically for prohibited content, and we may review, monitor, and moderate content and activity on the service. We may decline, block, or cancel any upload or order that violates these terms. If a book is blocked, rejected, or cancelled for safety or policy reasons, its coloring pages and cover have already been generated at our expense, so a non-refundable image-generation fee of US $10 is retained and the balance of any amount paid is refunded; orders we decline for reasons that are not your fault (such as our own production or quality issues) are refunded in full. We may suspend or permanently terminate access for anyone who misuses the service. Unlawful or otherwise inappropriate content may be reported to the appropriate authorities. We cooperate with law enforcement, and as required by law we report suspected child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC). We may preserve and disclose content or account information where we believe in good faith that it is necessary to comply with the law, enforce these terms, or protect the safety of any person.
Protecting children is the most important responsibility we carry, and we do not take it lightly. Colors of Life by Declan has zero tolerance for child sexual abuse material (CSAM) or any content that sexualizes, exploits, endangers, or abuses a minor in any way. Such content is absolutely prohibited — there are no warnings, second chances, or exceptions.
We screen every upload, and anyone who attempts to submit such content is permanently banned. We report suspected CSAM to the National Center for Missing & Exploited Children (NCMEC) and cooperate fully with law enforcement, including preserving and disclosing account and content information as the law allows or requires. We will pursue every lawful step to protect children and to hold offenders accountable. If you ever encounter anything on our service that could endanger a child, please email us immediately at hello@colorsoflifebydeclan.com.
Before you pay you review an on-screen proof of your layout, your cover and the first two coloring pages fully drawn; the remaining pages are drawn right after payment using the same process. Every finished book then passes a page-by-page check by a person before it is sent to the printer, and a book that does not meet our standard is not printed (see Returns). Please review your proof carefully, including names and spelling, as approved content is printed as submitted.
Prices are shown at checkout in US dollars. Payment is processed securely by Shopify. We do not see or store your full card details.
Because books are custom, once you approve your design and it is sent to print it cannot be changed or cancelled. Before that point, contact us and we will help if the order has not yet gone to production.
Custom items are generally not returnable, but we stand behind our quality. See our Return & Refund Policy.
The Colors of Life name, logo, site design, and templates are ours and may not be copied or used without permission. This does not affect your ownership of your own photos.
Our products and site are provided on an "as is" basis. To the fullest extent allowed by law, our total liability for any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses.
These terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-laws rules. You agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute arising from these terms or your use of the service.
We may update these terms from time to time. The "last updated" date above shows the current version.
